Subject to the “Dispute Resolution; Arbitration; Class Action Waiver” section below, you agree that the exclusive venue for any dispute not subject to arbitration shall be the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

17. Owner-Financed and Executory Contract Disclosures; SAFE Act.

Owner financing of residential real property in Texas may be subject to federal and state law, including the federal SAFE Act, the Truth in Lending Act, the ability-to-repay and loan originator rules under federal law, and the requirements governing executory contracts and contracts for deed under Texas Property Code Chapter 5, Subchapter D, including mandatory written disclosures, annual accounting statements, and recording requirements. Nothing on this website constitutes a disclosure required by those laws. 18. Binding Arbitration; Class Action Waiver; Jury Trial Waiver.

Except for claims that may be brought in small-claims court and except where prohibited by applicable law, you and Buy House No Banks agree that any dispute, claim, or controversy arising out of or relating to this website, these Terms and Conditions, or any communications between us, including claims under the Telephone Consumer Protection Act, shall be resolved exclusively by final and binding individual arbitration administered by a recognized arbitration provider under its applicable rules. You and Buy House No Banks waive any right to a trial by jury. Claims must be brought on an individual basis only, and you and Buy House No Banks waive any right to participate in a class, collective, consolidated, or representative action. If the class-action waiver is found unenforceable as to a particular claim, that claim shall proceed in court but this provision shall otherwise remain in effect. You may opt out of this arbitration agreement by sending written notice to us within 30 days of first accepting these Terms; opting out will not affect any other provision of these Terms. This provision is governed by the Federal Arbitration Act.

20. Acceptance of Terms. 

By checking the acceptance box, submitting a form, or otherwise affirmatively indicating your agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and the Privacy Policy. Where an affirmative acceptance mechanism is presented, your agreement is evidenced by that action and a record of your acceptance may be retained.
